Myth or Fact?:

If the victim chose to drink or use drugs, then it isn't considered sexual assault.

Answer

MYTH! The truth is, people who are intoxicated or high are unable to legally give consent to sexual activity. The inability to give consent also applies to being passed out and blackout situations.
